LabourNet Industrial Relations Plan



Introduction

Registration Fee

The client pays an up front registration Fee that enables LabourNet to proceed with the providing of the services to the client. Once the registration fee has been paid, you are allocated a consultant that shall commence with providing service to you. This includes:

A copy of the “What a tangled web we weave” will be delivered by an allocated consultant
LabourNet will conduct a comprehensive Labour Audit of your existing policies and industrial relation practices. The first four hours of the labour-audit process is free and thereafter the normal billiable rate will apply. The audit consists of:
Review of existing policies and contracts of employment;
Identifying and addressing short comings in application of industrial relations practices and procedures;
Drafting of new policies to align the company with best practices in industrial relations;
Drafting of new contracts of employment;
Ensuring registration with the relevant statutory bodies applicable to your company such as UIF and Bargaining Councils;
Implementation of polices and contracts developed during the labour audit;
Ensuring your management understands how to use the policies to be implemented.

The use of the handbook “What a tangled web we weave” as well as assisting the client to load the CD with the forms and precedents
The client will receive free attendance to the regular LabourNet Industrial Relations Seminars as well as regular News Letters

Monthly FEE:


The client pays a monthly retainer fee. And will receive Helpdesk Support that is provided on a daily basis from 08:00 to 17:00 on a Monday to Thursday and from 08:00 to 16:00 on a Friday. The retainer fee further includes an amount for “service cover”. All services rendered excluding HelpDesk services will be deducted from this cover. Once depleted this cover the client will be billed on an ad-hoc basis for all services rendered.


Service Cover


The client is provided with annual “service cover” related to monthly retainer fee. All services rendered will be deducted from this cover at an hourly.. Time will be calculated at minimum intervals of 10 minutes. If any consultation/service is less than 10 minutes, the fee will be calculated at a minimum of 10 minutes.

All services rendered excluding the Helpdesk Service will be deducted from the cover and invoiced for additional payment once the included cover is depleted. These services include but are not limited to the following:

All consultations with the client at the workplace or at LabourNet Office;
Telephonic consultations with the client excluding HelpDesk service;
Formulating disciplinary charges etc.;
Chairing of disciplinary hearings, appeal hearings, grievance hearings;
Performance consultations and/or counseling including final poor work performance investigations;
Wage and other trade union or individual employee negotiations;
Strike negotiations and strike handling;
Advising and management of retrenchments;
Testifying at arbitration hearings, con/arbs or Labour Court;
Drafting specific employment contracts or other contracts;
Drafting Labour relations policies and/or procedures;
Travel Time;
Travel Cost


CCMA / BC / Labour Court and Labour Appeal Court:


Labournet is a Labour Consultancy that provides pro-active advice to our clients. As such we do NOT represent clients at the CCMA, Bargaining Counsels or Labour Court. Where legal representation is allowed, we will refer the client to a preferred attorney to deal with the matter. Such representation will be a matter to be arranged by the client directly with the attorney. Due to our relationship with these attorneys, their services are provided to Labournet clients at a preferential and far reduced rate.

However we don’t leave our clients to their own devises when it comes to litigation. Other than providing our clients with access to a attorneys who are experts in labour law litigation, LabourNet will provide training to our clients, either in-house or a public training courses, on all aspects relating to conciliation and arbitration process and procedure. Not only will this empower the client and its staff, it will also result in a significant cost saving to the client. In addition to this, Labournet consultants are specifically trained to assist clients in preparing for arbitrations including the preparation of bundles and preparing witnesses to testify at the hearing.


Damage Cover


The client is provided damages cover for awards against the client for procedural fairness up to the total amount per annum as indicated above. The following conditions apply for the client to qualify for the damages cover:

As specified in detail in the Standard Service and Payment Agreement
Final dismissal hearing was conducted by a LabourNet consultant
The damage cover is provided on a “use it or lose it” basis per annum and unused cover is not carried over to the following year.
The LabourNet chairperson must be called to testify at the arbitration or adjudication of the matter if any procedural unfairness is alleged. The client will pay the normal hourly fee for any period of presence required by such consultant.
